Indefinite detention provisions are wrong

WASHINGTON - Libertarian Party Chair Mark Hinkle released the following statement today regarding the indefinite detention provisions of Senate version of the National Defense Authorization Act of 2012.

"The Obama administration has already claimed that the president has the authority to kill Americans overseas, if he believes they are terrorists.

"Now, in the latest National Defense Authorization Act, Congress is trying to give the president power to imprison Americans indefinitely, without charges or respect for habeas corpus, if he claims they are terrorists.

"Democrats and Republicans in the Senate have already joined hands to pass the bill.

"This contempt for our rights is outrageous. Any member of Congress who supports that provision is grossly violating his or her oath to uphold the Constitution.

"If the president thinks you are a terrorist, let him present charges and evidence to a judge. He has no authority to lock you up without any judicial review, just because he and Congress believe he should have unlimited power.

"That is the kind of power held by tyrants in totalitarian regimes. It has no place in the United States.

"The Libertarian Party opposes terrorism. We also believe our government should stop taking actions that provoke terrorism. We want to end military involvement in Iraq, Afghanistan, and many other countries, and we want to repeal the Patriot Act."

Sen. Paul Statement on Defeat of Detainee Amendment

WASHINGTON, D.C. – Yesterday nnight, Sen. Rand Paul prevented the passage of an amendment that would have further eroded Americans' constitutional rights. Offered to the National Defense Authorization Act for Fiscal 2012 (S.1867), amendment No. 1274 would have allowed the U.S. government to detain an American citizen indefinitely, even after they had been tried and found not guilty, until Congress declares an end to the war on terror.

"Suspicion of committing a crime should lead to your attempted prosecution. If the evidence does not support conviction, it would be against everything we believe in and fight for in America to still allow the government to imprison you at their whim," Sen. Paul said. "Tonight, a blow was struck to fight back against those who would take our liberty."

The amendment would have passed by voice vote, but this tactic was blocked by Sen. Paul's objection. He then forced a roll call vote, in which the amendment was defeated, 41-59.

Sen. Paul earlier this week introduced an amendment to formally end the war in Iraq. Despite the fact that troops will be removed from Iraq at the end of this year, the amendment failed 30-67.

Conservative Party Could Have Helped “Super Committee”

Although the Conservative Party congratulated the GOP and the Tea Party for giving Obama and the Democrats a shellacking last November, we’re finding little to cheer about this November.  The Debt Ceiling fiasco was… well... a fiasco and Congress still has not enacted a budget in nearly 1,000 days.

The Super Committee is proof positive of only one thing: It proves the Republi-Dem Congress and the Administration have failed to govern – again.  They shifted the burden and responsibility of making the needed tough fiscal decisions to this Committee.  The President has failed to lead and the Republi-Dem congress is as inept, hamstrung and wracked with fear as ever. The consequences of this Committee’s failure to reach an agreement will be dire, especially on our Defense readiness.  And trying to insert a surreptitious farm subsidy bill into this new arrangement exemplifies “business as usual” rather than true fiscal reform.

Since Congress failed - again, CP-USA offers a Cost-Cutting Road Map. While adopting these solutions will not cure all our fiscal problems immediately, they will staunch the bleeding, slow the mounting debt and get Congress moving in the right direction.  The GOP has no choice but to finally do what it has promised Americans for the past 25 years.  They have this one, last and final chance.  If they fail – again – the GOP will confirm that it’s finished as a viable party.

STEP 1 of 13 - STOP BASE LINE BUDGETING: This pernicious accounting gimmick requires budgets to automatically increase by 10% every year. The net effect is that even if Congress “cuts” a program by 4%, for example, actual spending still increases by 6%. The “cut” is an illusion while the increase is real. It will be impossible to make meaningful budget reforms until this institutional deception is expunged.
